The high court of Bombay has ordered the MCI to give consent to the first year medical student from the state of Maharashtra who wants to swap to the second year of a medical college in Karnataka. Authorities have already given the NOC’s to the students in Karnataka.
The bench said that it was quite late for the transfer since the approvals were completed last month. However, the bench directed the MCI to not repudiate permission because the exchange was in the favour of the career of student, the MCI may take the application.
Advocate A.V Anturkar who presented the students to the court informed the bench that college had a vacant seat in the second year. Also, the college was willing to take the student in. MCI student allows the students to transfer.
He also informed the court that the student had got NOC’s from all the admissible authorities in Karnataka.
Students can swap colleges after first year of their MBBS course. Also, the transfer process is merit basis and only authorized by the Indian Medical Council.
Colleges are supposed to submit the number of seats vacant to the council and applicants are permitted these MBBS seats on merit basis. This process was carried out in December by the council and Raichur was applying after the deadline.
